    TitanWave is not a law firm and does not provide legal advice to employers or employees. Instead, we serve as a coordination hub, bringing together qualified employment law attorneys to ensure the Employee Protection Assurance Program (EPAP) is implemented correctly, legally, and fairly.

    Our Attorney Support Services facilitate professional legal review of all EPAP agreements, coordinate multi-party legal consultations, and ensure compliance with employment law across jurisdictions. We handle the logistics so that attorneys can focus on substantive legal issues.

    All legal coordination costs are included in EPAP implementation fees. Organizations and employees do not pay separately for attorney involvement in the standard program.

    For Employee Legal Counsel

    If you represent an employee who has been offered an EPAP agreement, we provide support for your review:

    Independent Review Facilitation

    We facilitate, but don't control, your client's independent legal review. You'll receive all necessary documentation, background information, and answers to technical questions without employer interference in your review process.

    Comparison Analysis

    We provide objective comparison materials showing how EPAP terms compare to standard severance packages, WARN Act protections, and typical workforce reduction scenarios. This helps you advise your client on the relative value of the offer.

    Negotiation Support

    While core EPAP terms are standardized, certain provisions are negotiable. We facilitate negotiation discussions between you and employer counsel, helping reach fair resolutions without adversarial positioning.

    Funded Legal Review

    Employer organizations cover reasonable attorney's fees for employee legal review (typically up to $2,500). We coordinate payment so your client doesn't bear the cost of reviewing their EPAP agreement.

    Standard Legal Review Process

    Initial Framework Development

    TitanWave works with employer legal counsel to customize EPAP framework for the specific organization. We provide templates, compliance analysis, and coordination support. Timeline: 4-6 weeks.

    Employer Counsel Review

    Organization's legal counsel reviews customized framework, provides feedback, and approves for employee distribution. We coordinate revision cycles and version control. Timeline: 2-3 weeks.

    Employee Distribution and Review Period

    Employees receive EPAP agreements with mandatory 21-day review period. We provide attorney referrals if requested and coordinate legal review funding. Timeline: minimum 21 days.

    Employee Counsel Review

    Individual employees consult with their chosen attorneys. We provide supporting documentation, answer technical questions, and facilitate any negotiation discussions. Timeline: 1-3 weeks.

    Agreement Execution

    After independent review and any negotiations, agreements are executed. We coordinate signature process, manage document retention, and ensure proper legal filings. Timeline: 1-2 weeks.

    Ongoing Legal Support

    Throughout 5-year program term, we provide ongoing legal coordination for amendments, dispute resolution, compliance monitoring, and regulatory updates. Timeline: continuous.

    Common Legal Issues We Address

    Multi-State Compliance

    Organizations with employees in multiple states face varying employment law requirements. We coordinate legal review across jurisdictions, ensure compliance with each state's specific requirements, and adapt EPAP agreements to maintain enforceability everywhere employees are located.

    WARN Act Compliance

    Federal WARN Act and state "mini-WARN" laws require specific notice periods for mass layoffs. EPAP agreements are structured to either comply with or supersede WARN requirements, depending on the organization's preferences and legal counsel's recommendations.

    ERISA Considerations

    Income guarantee provisions may trigger ERISA "top hat" plan requirements. We work with benefits attorneys to structure agreements appropriately, file required documents, and maintain compliance with ERISA's complex regulations.
